Instructions To Accept Reduction Of Charge By Mail

If you would like to take advantage of the reduced charge offer, please follow these instructions:

1. Click on the traffic waiver generator.  This will automatically generate a plea bargain for you based upon the charge that you input.  Please be sure to be accurate when filling this form out, as all information you submit will be verified by the court and the District Attorney's Office.  Failure to submit accurate information could result in a delay in your plea bargain, and submitting false information may result in revocation of any plea offer.

2. After the traffic waiver has been generated, please print out the waiver form, sign it, and then mail it to the Broome County District Attorney's Office.  The Address is:

Broome County District Attorney
c/o (court you recieved the ticket) Traffic
P.O. Box 1766
Binghamton, NY 13902

*Note Do not worry if the waiver prints out in a small font/size, the size that the waiver prints out will vary based upon your computer.
*Note, do not mail the waiver to the Court.

Please remember that all waivers received are subject to the Court's approval.

Upon receipt of the waiver form, the Court will send you a notice of fine and surcharge with information on how to pay and when the money is due.

Please note that the fine for any traffic infraction is set by the judge, following mandatory New York State guidelines.  The fines increase with each speed category.  Therefore, by making a plea to a reduced charge, you are allowing the judge to impose a fine from within a lower fine category, although it is always within the Court's discretion to determine where to set the fine within the range set by law.  The surcharge is set by the State.

If you have further questions regarding the amount of your fine, please contact the Court.

Remember to include your current address for the Court, because if the Court cannot reach you at the address you have given, your license will be suspended.
