NOTICE OF PUBLIC HEARING CONCERNING THE CONTINUATION OF BROOME COUNTY AGRICULTURAL DISTRICT NO. 5 IN THE TOWNS OF BARKER, LISLE, MAINE, NANTICOKE AND TRIANGLE IN THE COUNTY OF BROOME, NEW YORK, FOR AN ADDITIONAL EIGHT (8) YEAR PERIOD
PLEASE TAKE NOTICE, that a Public hearing will be held before the Broome County Legislature on August 19, 2010 at 5:00 PM, in the Broome County Legislative Chambers, Sixth Floor, Edwin L. Crawford County Office Building, Government Plaza, Binghamton, New York pursuant to Section 303 of Article 25-AA of the New York State Agriculture and Markets Law, on the question of the continuation, by the Broome County Legislature, of Broome County Agricultural District No. 5, located in the Towns of Barker, Lisle, Maine, Nanticoke and Triangle, for an additional eight (8) year period.
PLEASE TAKE FURTHER NOTICE, that during the statutory thirty day period for public review, commencing June 1, 2010, following the publication on May 25, 2010 of the notice of said period for public review, as provided for and permitted by Section 303, Paragraph 2 of Article 25-AA of the Agriculture and Markets Law, modifications to Broome County Agricultural District 5 were filed.
PLEASE TAKE FURTHER NOTICE, that a description and map of the Agricultural District and proposed modifications and recommendations of the Broome County Agricultural and Farmland Protection Board, the Broome County Department of Planning and Economic Development and the Broome County Legislature (as lead agency for SEQR compliance) may be inspected and examined in the Office of the Clerk of the Broome County Legislature.
PLEASE TAKE FURTHER NOTICE, that the Broome County Department of Planning and Economic Development and the Broome County Agricultural and Farmland Protection Board, by reports duly filed, have recommended that said Broome County Agricultural District No. 5 be continued for an additional eight (8) year period, except that both the Department of Planning and Economic Development and the Agricultural and Farmland Protection Board have recommended modifications to Agricultural District No. 5 as follows:

PLEASE TAKE FURTHER NOTICE, that the Broome County Legislature as the lead agency designated for SEQR compliance, has examined the environmental impact within and adjacent to the District and recommends continuation of the District as same represents a positive contribution to environmental quality in the area.
PLEASE TAKE FURTHER NOTICE, that said public hearing will be held concerning continuation of Broome County Agricultural District No. 5 together with the recommendations of the Broome County Department of Planning and Economic Development and Broome County Agricultural and Farmland Protection Board.
PLEASE TAKE FURTHER NOTICE, that all interested parties and citizens will be heard by the Broome County Legislature at the Public Hearing to be held as aforesaid.
